Raksta mērķis ir atspoguļot bargākā no sodu sistēmā ietvertajiem pamatsodiem-brīvības atņemšanas soda-noteikšanas un izpildes nosacījumus caur normatīvā regulējuma, teorijas un prakses prizmu. Sodu ar brīvības atņemšanu un cietumu kā šī soda izpildes vietu pamatoti uzskata par vieniem no vispretrunīgākajiem institūtiem sabiedrisko attiecību regulēšanas sfērā. Cietuma cena ir augsta tiešā un netiešā nozīmē. Mūsdienās par brīvības atņemšanas soda galveno mērķi tiek izvirzīta notiesāto personu resocializācija, tomēr šī mērķa sasniegšanas iespējas nav augstas. Tiek meklēti efektīvāki risinājumi noziedzības ierobežošanai. Arvien vairāk tiek ieviesti brīvības atņemšanai alternatīvie sodi jeb sabiedrībā izciešamie sodi, kuru kriminālās represijas līmenis ir zemāks, bet efektivitāte ir augstāka. Tas ir politiskās gudrības un tālredzības pierādījums, jo šo risinājumu pamatā ir sabiedrības, noziegumos cietušo un likumpārkāpēju interešu līdzsvarošana. Galarezultātā pieaug sabiedrības drošība.

Execution of imprisonment-statutory regulation, legal doctrine and judicial practice
The aim of the article is to examine the conditions governing the imposition and execution of imprisonment—the most severe principal penalty within the system of criminal sanctions—through the prism of statutory regulation, legal doctrine, and judicial practice. Imprisonment, and the prison as the institutional framework for its enforcement, are widely regarded as among the most controversial mechanisms in the sphere of regulating social relations through criminal law. The cost of imprisonment is significant, both in direct financial terms and in its broader social and systemic implications. In contemporary criminal justice policy, the primary objective of a custodial sentence is the resocialisation of convicted persons. However, the practical prospects of achieving this objective remain limited. Consequently, legal systems increasingly seek more effective and sustainable responses to crime control.In this context, growing emphasis is placed on alternatives to imprisonment—namely, community-based sanctions—characterised by a lower degree of penal repression yet demonstrably higher rehabilitative and preventive potential. The expansion of such measures reflects political prudence and long-term strategic foresight, as it is grounded in balancing the interests of society, victims of crime, and offenders. Ultimately, this approach contributes to enhanced public safety and a more proportionate criminal justice framework.
